Leak of CCI report on Google

Issue

A reported leakage of CCI investigation report has prompted search-engine major Google to approach Delhi High Court.

 

Background

The CCI had launched an investigation against violation of competition rule regarding dominance in the Android Smartphone market. 

 

Details

  • The leaked report says that Google has used its influence and power to restrict manufacturers from developing and selling alternative versions of its Android operating system.

  • Google approached the court saying that leakage prevents the company from defending itself against the allegations.

  • Director General of the CCI’s investigative report is not final and is reviewed by members of CCI before a judgment is passed.

  • The company says that it had given its cooperation and maintained confidentiality during the investigations and had expected the same in return.

 

The allegations against Google

  • To pre-install Google play store, smartphone manufacturers had to sign an agreement with Google that prevented them from developing and selling alternative versions of android.

  • The allegations had prompted CCI to launch an investigation in 2019. The prima facie evidence had suggested a violation of competition rules.

  • Similar anti-trust case is being faced by Google regarding its conduct in smart television market. This will go a long way in framing business rules.

 

Competition Commission of India

  • Competition Commission of India is a statutory body within the Ministry of Corporate Affairs. It is responsible for enforcing and regulating competition rules.

  • The Commission members are appointed by the Central Government and comprise a Chairperson and not less than 2 and not more than 6 other members.
