The Goa Bhumiputra Adhikarini Bill, 2021 was passed by the legislative assembly of Goa amidst walk-out by the opposition.
The bill will recognize any person living in the state for 30 years or more as ‘Son of the Soil (Bhoomiputra). This will allow them to own a dwelling unit.
This will allow an individual to live with dignity and self-respect by getting ownership right to the self-occupied dwelling.
Any house not more than 250 sq m can be claimed by a person pronounced as a Bhoomiputra provided the house was constructed before April 1, 2019.
The beneficiaries will be residents who have built houses and living on their ancestral lands. The ownership issue of these lands is not yet clarified.
The law will cover panchayat land, ancestral property, communidade property and also other government owned property such as forest lands.
Applying for the scheme
A committee known as Bhumiputra Adhikarini will be constituted, which will be chaired by Deputy Collectors and other officials such as departments of Town and Country Planning, Forest and Environment etc will be members.
The bill will apply to the house built before cut-off date. Objections regarding the property can be given by the respective owners within 30 days of giving of title.
The ownership title will not be given for free. The Bhoomiputra title owner will have to pay an amount equivalent to the value of land calculated at the market rate.
Opposition says that the bill has not been studied enough and it will provide opportunity for illegal slum dwellers to occupy a land legally.
The courts will not have any jurisdiction to take up cases under the Bhoomiputra bill. It has to be decided by the Bhumiputra Adhikarini and administrative tribunal.
