MH17 crash

A legal case will be launched by Australia and the Netherlands against Russia over its alleged role in the downing of Malaysia Airlines flight MH17.



The Malaysian Airlines was destroyed in mid-air by a missile and crashed in Donetsk region of Ukraine in 2014.



  • The incident happened immediately after the annexation of Crimea by Russia and the missile that destroyed the plane was said to be Russian.

  • All 298 passengers and crew on board were killed during the crash. The plane had taken-off from Amsterdam and flying towards Kuala Lumpur.

  • The people on board included 196 Dutch nationals, 43 Malaysians, and 38 Australians. The incident took place during Ukrainian civil war.


Legal actions

  • Legal proceedings were initiated after Russia withdrew from negotiating further. Netherlands and Australia decided to fight the case legally.

  • Case will be enrolled before International Civil Aviation Organisation (ICAO) under Article 84 of the Convention on International Civil Aviation. 


The 2014 crash

  • The civil protests in Ukraine had necessitated pro-Russian leader Viktor Yanukovych to flee the country for his decision to forego deal to integrate Ukraine into European Union.

  • Russia immediately annexed Crimea and integrated it into their country through a controversial referendum. The rebel regions of Donetsk and Luhansk also declared independence.

  • During the war, the MH17 flight mysteriously disappeared while flying over eastern Ukraine. Later it was found to be hit with a missile that caused it to crash.


Charges against Russia

  • Australian officials claim that there are evidences to show that the surface to air missile system was Russian.

  • There are evidences of its movement from Russia to an agricultural field in eastern Ukraine, and later return back to Russia.


Causes of the crash

  • Dutch investigations revealed that the plane was hit by a Buk missile system having 9N314M-type warhead that resulted in mid-air detonation of aircraft.

  • The investigations further said that eastern Ukrainian airspace had to be cordoned off if flying was not allowed but instead many commercial aircrafts were allowed to fly.


Russia’s defence

Russia has accused Ukraine of deliberately pushing the aircraft towards the war zone. The identification of the plane showed it to be a Ukrainian fighter jet on radar system.
