SC order on illegal religious structures

A political storm has been created in Karnataka over a 2009 SC-order that had instructed destruction of illegal religious structures.



The mid-night razing of a temple structure in Mysuru has been criticized by leaders of both the ruling party and the opposition.



  • The 2009 SC order on the Union of India vs. State of Gujarat case says that “no unauthorized construction shall be carried out or permitted in the name of temple, church, mosque or gurudwara, etc. on public streets, public parks or other public places, etc”.

  • In 2019, the Karnataka High Court took suo motu petition and instructed that illegal religious structures built after September 2009 is demolished.

  • The state government was reprimanded by the High Court many times over the past couple of months. It forced the government to direct officials to remove or relocate structures as per the guidelines.


The controversy

  • The drive was carried out without much noise until a video became viral on social media that showed destruction of a temple in Nanjangud.

  • Opposition leaders and several ruling party leaders questioned the government’s stand. The state government halted all the process until fresh guidelines were issued.


Way ahead

  • The Chief Minister has introduced a new bill in the legislative assembly for protection of religious structures being targeted for removal. 

  • The bill will most likely to be passed with support from majority of members cutting across the party lines.
