Lok Sabha passed Jammu and Kashmir Reservation (Amendment) Bill, 2019 to provide reservations in educational institutions and government jobs to people living along International Border in Jammu area. The Bill amends Jammu and Kashmir Reservation Act, 2004 and replaces an Ordinance promulgated in March 2019.
Jammu and Kashmir Reservation Act, 2004
- It provides for reservation in appointment and promotions in J&K state government posts, and admission to professional institutions for certain reserved categories. Professional institutions include government polytechnics, medical colleges and dental colleges.
- Reservation: It provides for reservation in appointment and promotions in certain state government posts to persons belonging to socially and educationally backward classes (SEBCs). It defines SEBCs to include persons living in areas adjoining Actual Line of Control (LoC).
- Mandatory tenure of service: It mandates minimum seven years of service to any person appointed on the basis of residence in an area adjoining Line of Control (LoC) in such areas.
- Exclusion from reservation: It does not grant reservation under SEBC category to any person whose annual income exceeds Rs. 3 lakh or other amount as notified by state government. However, this exclusion is not applicable to persons living in areas adjoining Actual LoC.
Jammu and Kashmir Reservation (Amendment) Bill, 2019
It expands SEBC reservation facility to those persons living in areas adjoining International Border. It also mandates minimum seven years of service condition to persons living in areas adjoining International Border as well. It excludes persons living in areas adjoining the International Border from exclusion from reservation based on economic (income) criteria.
