Delhi and Mumbai Police have registered separate cases against perpetrators of ‘Bully Bai’ app for online bullying.



The “Bulli Bai’ was an app that was created on GitHub coding repository. The app was involved in mock auction of Muslim women.



  • Section 67 of the Information Technology Act and Sections 153A, 153B, 295A, 354D, 500 and 509 of the Indian Penal Code (IPC) were invoked against the accused.

  • Section 153A is related to the offence of promoting enmity between different groups on grounds of religion, etc and doing acts prejudicial to maintenance of harmony.

  • Section 295A provides punishment for deliberate and malicious acts, intended to outrage religious feelings.

  • Section 153B relates to imputations, assertions prejudicial to national-integration.

  • Section 354D is related to the offence of stalking by monitoring the use by a woman of the internet, email or any other form of electronic communication with malintent.

  • Section 67 of IT act lays emphasis on punishment for publishing or transmitting obscene material in electronic form.



  • There are provisions of extending the punishment to five years of imprisonment with fine, in the case of second or subsequent conviction.

  • Punishment under IT act attracts three years imprisonment and fine up to Rs 5 lakh and the second or subsequent conviction may lead to imprisonment up to five years and fine up to Rs 10 lakh.


Responsibility of intermediaries

  • Intermediaries are required to retain the requisite data for duration as prescribed by the Government and present them to authorities when demanded.

  • The intermediaries, on court’s order, are not allowed to host, store or publish any information declared unlawful.

  • They have to take all reasonable and practicable measures to remove or disable access to it within 24 hours of receipt of complaint on behalf of an individual.
